Terms and Conditions for Real Estate Auction

By participating in this real estate auction, all bidders and potential buyers agree to be bound by the following terms and conditions:

1. Financing and Approval

  • Buyer Financing: If financing is required for the purchase, the buyer must have prior approval from a reputable lender before participating in the auction. Proof of financing or pre-approval must be submitted to Alden’s Real Estate for winning bid.
  • Cash Purchases: Buyers paying in cash must also be prepared to demonstrate proof of available funds upon request.

2. Winning Bid and Deposit

  • Down Payment: The winning bidder will be required to make a non-refundable down payment of 3.5% of the final bid amount within 24 hours of the auction closing. This down payment will be held in escrow and applied toward the final purchase price at closing.
  • Payment Method: Accepted forms of payment for the down payment include wire transfer, certified check, or another agreed-upon method. Specific payment instructions will be provided to the winning bidder.

3. Due Diligence

  • Buyer Responsibility: It is the buyer’s responsibility to conduct all necessary due diligence prior and up to 3 days after the auction. This includes reviewing property disclosures, conducting inspections, researching the title, and ensuring the property meets their expectations and requirements.
  • 3-Day Inspection Period: The Buyer shall have a 3-day inspection period during which they may have a licensed professional inspect the property for any defects or issues. Within this period, the Buyer has the right to cancel the purchase if the property does not meet their expectations or standards.

4. Change of Mind or Default

  • Non-Refundable Deposit: If the buyer changes their mind for any reason after the 3-Day inspection period, the down payment will be forfeited. The buyer is committing to purchase the property upon winning the auction, and any failure to follow through with the transaction after the inspection period will result in the loss of the down payment.
  • Breach of Terms: In the event of a breach of these terms, the seller reserves the right to pursue any legal remedies available, including retaining the deposit and re-listing the property for sale.

5. Closing and Transfer of Ownership

  • Closing Date: The closing date will be agreed upon between the buyer and the seller and will typically occur within 30-45 days of the auction's conclusion, unless otherwise specified.
  • Title Transfer: Upon successful closing, the title to the property will be transferred to the winning bidder, subject to the terms and conditions of the sales agreement. Buyer is responsible for paying any tile insurance and fees. 

6. Auction Conduct

  • Auctioneer’s Discretion: The auctioneer reserves the right to cancel or reschedule the auction at their discretion. The auctioneer also has the right to refuse any bid or disqualify any bidder who does not comply with the terms and conditions outlined here.
  • Bidder Identification: All bidders must register prior to the auction. Failure to register may result in disqualification from bidding.

7. Limitation of Liability

  • No Warranty: The property is sold as-is with no warranties expressed or implied. The seller makes no representations regarding the condition of the property, its title, or any legal encumbrances that may exist.
  • Limitation of Liability: The seller and Alden’s Real Estate will not be liable for any errors or omissions in the auction process or for any damages or losses incurred by the buyer in connection with the auction.
